This standard specifies the requirements and provides guidelines to establish, develop, implement, evaluate, maintain and continuously improve a compliance management system on free competition issues within an organization. The standard is particularly applicable to risk management and control systems in the field of free competition, establishing requirements and guidelines to have models in line with the legislation applicable to organizations operating in Spain, in terms of prevention, detection and reaction against practices contrary to free competition. This standard is applicable to all organizations, regardless of type, size, nature of activity and whether in the public, private or not-for profit sector and in the activities carried out, both by the members of the organization and by business associates who act, following instructions from the organization, representing it or in its Benefit. All requirements specified in this document that refer to a governance body apply to top management where an organization does not have a governance body as an independent function. The great groups of anticompetitive behaviours that can occur in an organization are: - Collusive behaviours; - Abuse of dominant position; - Competition distortions produced by unfair acts; - Economic concentrations of non-reported or authorized organizations, in its case; - Public aids or aids form the government that exceed regulatory limits and/or may restrict free competition.
